Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Clawza platform operated by Clawza, Inc.. By creating an account or using the Service you agree to these Terms.

1. Eligibility & accounts

You must be 18+ and able to form a binding contract. You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it current.

2. Subscriptions, credits & billing

Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor (Stripe) and renew automatically until cancelled. Plans include a monthly allotment of credits/usage that resets each billing period and does not roll over unless stated. One-time credit top-ups may expire as described at purchase. We may change pricing with notice; changes apply to your next billing cycle.

3. Free trial

Trials, where offered, provide limited credits to evaluate the Service. We may modify or end trials at any time. No charge occurs unless you choose a paid plan.

4. Cancellation & refunds

You may cancel anytime from Settings or the billing portal; your plan stays active through the end of the current paid period and is not renewed thereafter. Refunds are governed by our Refund & Cancellation Policy.

5. Acceptable use

You agree not to use the Service to: send unsolicited bulk email in violation of anti-spam laws; harvest data unlawfully; generate or distribute illegal, deceptive, infringing, hateful, or harmful content; impersonate others; attempt to breach security or access other tenants’ data; resell the Service except as expressly permitted; or violate the terms of any third-party platform you connect. You are solely responsible for your campaigns, your recipients, and the content you generate and send.

6. Your content & intellectual property

You retain ownership of the content and outputs you create with the Service (landing pages, copy, images, video, leads you collect). You grant us a limited license to host, process, and transmit that content solely to operate the Service for you. Clawza retains all rights in the platform itself. AI-generated outputs are provided for your use; you are responsible for reviewing them before publishing or sending.

7. Third-party integrations

The Service lets you connect accounts you control (e.g. Instantly, Meta, Pipeboard, Google). You are responsible for those accounts, their costs (including ad spend, which is charged to you, not Clawza), and compliance with their terms. We are not liable for third-party services’ availability or actions.

8. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee specific results, lead quality, email deliverability, ad performance, or revenue. AI outputs may contain errors. To the maximum extent permitted by law we disclaim all warranties, express or implied.

9. Limitation of liability

To the maximum extent permitted by law, Clawza, Inc. will not be liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Clawza, Inc. harmless from claims arising out of your content, your campaigns, your use of connected accounts, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service anytime. We may suspend or terminate accounts that violate these Terms or create risk. On termination your right to use the Service ends; certain provisions survive (IP, disclaimers, liability, indemnity).

12. Governing law

These Terms are governed by the laws of the United States and the state in which Clawza, Inc. is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction.
